That would certainly be determined right up front in the first conversation with them. However, they would know of any attorneys in the nation who might be willing to listen. It sounds as if he has a very weak case from lack of disclosure of the risk, but the odds are pretty good that was covered in the fine print of the consent form that was agreed to, leaving absolutely nothing. For peace of mind of the victim, it might be advisable to make the call just to be able to get on with the business of life.
